Governmental responsibility for the safe operation of nuclear installations

In close coordination with the author of the first contribution to this volume, which deals with the 'licensing phase', this study analyses all decision-making procedures of the supervisory authorities after the commissioning of a nuclear installation, i.e. in the 'supervising phase'. Section A deals with the tasks of and limits to governmental provisions against damage during operation with respect to rquirements of constitutional law, in particular with provisions against damage as a problem of supervision, 'remaining risk' and 'risk reduction', individual risk or total risk, obligation to implement 'dynamic provisions against damage', scope of discretion in supervision; retrofitting as a concern of supervisory measures, typical cases of retrofitting; safeguarding of industry and 'indemnification'. In section B the individual governmental measures - obligatory and facultative revocation, withdrawal and alteration of the licence, subsequent imposition and obligations and orders - are analysed and set in relation to each other.
