New Developments of the Law of the Sea in the Nuclear Field

Description
Following the 6th Session (July 1977) of the Conference on the Law of the Sea an Informal Composite Negotiating Text was released which has a direct bearing on several aspects of the peaceful uses of nuclear energy. These are, in particular, navigation of nuclear-powered merchant ships and their right of passage in territorial waters, their safety and the sea disposal of radioactive waste. It seems from the present status of the work of the Conference that the amendments likely to be made to the Law of the Sea will not impede the development of nuclear-powered navigation and the discussions stress the importance of the role international organisations should continue to play in this field. Abstract (French)
A l'issue de la sixieme sesion (juillet 1977) de la Conference des Nations-Unies sur le droit de la mer, le resultat des travaux contenu dans un 'texte informel composite de negociation', interesse directement plusieurs aspects des utilisations pacifiques de l'energie nucleaire. Il s'agit notamment de la navigation commerciale des navires a propulsion nucleaire et notamment du droit de passage dans les eaux territoriales, de la securite de ces memes navires, et du rejet en mer des dechets radioactifs. Il ressort de l'etat actuel des travaux de la Conference que les changements susceptibles d'etre apportes au droit de la mer ne sont pas de nature a contrarier le developpement de la navigation a propulsion nucleaire et soulignent l'importance du role que devraient continuer a jouer dans ce domaine les organisations internationalesFiles
