Building construction permits just like plant construction permits under the Federal Emission Control Act or the Atomic Energy Act are typical cases representing the administrative order with a dual effect, or an effect on third parties: decisions supporting the interests of the project owner always affect third parties. Third party protection therefore is a major topic of public construction law or the environmental protection law to be applied to industrial installations. Although actions brought by third parties have become something ordinary for the administrative courts, substantive third party protection continues to pose specific problems. The book in hand develops and explains a way out of the dilemma created by third party protection. The solutions presented are founded on a sound dogmatic basis and take into account the Federal Constitutional Court's rulings in matters of civil rights. The starting point adopted by the authors is the third party rights warranting protection, with the objective protection provided for by the law in general gaining effect as subjective rights as far as the protection is based on the civil rights of the constitution. The scope of protection affordable depends on the individual case and the reconciliation of terests of all parties concerned. The problem solutions set forth very extensively rely on the jurisdiction in matters of third party protection and on approaches published in the relevant literature, so that the book also may serve as a guide to current practice and a helpful source of reference for readers looking for information about the issue of third party protection. Baugenehmigungen ebenso wie immissionsschutzrechtliche oder atomrechtliche Anlagengenehmigungen sind typische Faelle des sogenannten Verwaltungsaktes mit Doppelwirkung oder Drittwirkung: Die Beguenstigung des Bauherrn hat jeweils die Belastung von Dritten zur Folge. Der Rechtsschutz dieser Drittbetroffenen ist eines der zentralen Probleme im oeffentlichen Baurecht und anlagebezogenen Umweltrecht. Obwohl die Drittbetroffenenklagen schon seit Jahrzehnten zum Alltag der Verwaltungsgerichte gehoeren, ist der materielle Drittschutz nie problemlos geworden. Die Arbeit zeigt einen dogmatisch fundierten und mit der Grundrechts-Rechtsprechung des Bundesverfassungsgerichts harmonisierten Weg zur Ueberwindung des ''Dilemmas des Drittschutzes'' auf. Ausgangspunkt fuer die dogmatische Neuorientierung sind die rechtlichen Schutzpositionen der betroffenen Dritten. Dabei haben die im einfachen Gesetzesrecht enthaltenen objektiven Schutzpositionen insoweit subjektive Wirkung, wie sie grundrechtlich fundiert sind. Wie weit diese Schutzwirkung geht, ist in abwaegender Zuordnung der Rechtspositionen des betroffenen Dritten und der entgegenstehenden Rechte und Interessen anderer (insbesondere der Bauherren) im Einzelfall zu klaeren. Bei der Untersuchung wurde auch Wert auf die sorgfaeltige Darstellung der gerichtlichen Praxis des Drittschutzes und der verschiedenen in der Literatur geaeusserten Loesungsansaetze gelegt. Die Arbeit kann in diesen Teilen als Nachschlagewerk benutzt werden und bietet einen Ueberblick ueber die Drittschutzfrage. (orig./HP)Additional details
