Procedural law problems with the construction of installations (plants) for the final storage of radioactive materials

Description

The underground exploration of the salt-mine Gorleben has to be permitted according to sec. 126 para. 3, 51 et seq. Federal Mining Act. There is, however, no need for carrying out a nuclear law procedure for the official approval of the plan because the construction of the exploration mine does not represent the construction of a final storage facility. The operation of exploration measures does not create legally relevant prejudices for procedures of the official approval of the plan according to Atomic Energy Law. (HP)

Abstract (German)

Das fuer die untertaegige Erkundung des Salzstocks Gorleben geplante Bergwerk bedarf der bergrechtlichen Zulassung gemaess Para. 126 Abs. 3, 51 ff. BBergG. Die Durchfuehrung eines atomrechtlichen Planfeststellungsverfahrens ist dagegen vor Abschluss der untertaegigen Erkundung nicht geboten, weil der Bau des Erkundungsbergwerks noch nicht die Errichtung des Endlagers darstellt. Denn die Durchfuehrung der Erkundungsmassnahmen schafft keine rechtlich relevanten Praejudizien fuer das atomrechtliche Planfeststellungsverfahren. (HP)
