Judicial aspects in risk assessment
Description
Decisions of administrative authorities concerning the permission to use fissile material contain a prognosis about the probability of damage which may be caused by using this material. The judicial criteria used in order to determine the probability of such a damage occurring can be improved by risk analysis. This will not, of course, reduce administrative decisions to simple 'yes-or-no decisions', but the calculation of probabilities will gain more exactness. (orig.)

Die Entscheidungen von Verwaltungsbehoerden, mit denen die grundsaetzlich verbotene Verwendung von spaltbaren Stoffen erlaubt wird, setzen eine Prognose ueber die Wahrscheinlichkeit der Beeintraechtigung von geschuetzten Rechtsguetern durch die Verwendung voraus. Die juristischen Kriterien, die zur Bestimmung der Wahrscheinlichkeit eines Schadenseintritts verwendet werden, koennen durch Risikobeurteilungen verbessert werden. Damit lassen sich die Behoerdenentscheidungen zwar nicht auf eine einfache Ja/Nein-Entscheidung reduzieren, wohl wird aber eine exaktere Wahrscheinlichkeitsbestimmung moeglich. (orig.)
