First general administrative regulation concerning the Accident Ordinance (1. StoerfallVwV)
Description
This administrative regulation specifies the scope of application (section 1) of the Accident Ordinance, the legal requirements for granting exemptions (section 10), and the procedure of notification (section 12). The regulation thus presents clear instructions to be observed by the licensing and supervisory authorities of the Lands in the implementation of the amended Accident Ordinance, and at the same guarantees application of standard procedure in practice by all Federal Lands. The regulation also provides for incorporation into German law of the EC council directive on the hazards of serious accidents in specific industries (the Seveso directive). (orig./HSCH)
Abstract (German)
Ziel ist: den Anwendungsbereich (Paragraph 1) der Stoerfall-Verordnung zu konkretisieren, die Voraussetzung fuer die Gewaehrung von Ausnahmen (Paragraph 10) festzulegen, das Verfahren fuer die Durchfuehrung der Anzeige (Paragraph 12) zu bestimmen. Die Genehmigungs- und Ueberwachungsbehoerden der Laender erhalten damit klare Vorgaben fuer ihre diesbezueglichen Entscheidungen bei der Umsetzung der novellierten Stoerfall-Verordnung. Zugleich wird damit eine bundeseinheitliche Vollzugspraxis sichergestellt. Darueber hinaus werden Teile der EG-Richtlinie ueber die Gefahren schwerer Unfaelle bei bestimmten Industrietaetigkeiten (sog. Seveso-Richtlinie) umgesetzt. (orig./HSCH)Additional details
