Federal Administrative Court: Statement concerning a constitutional dispute over the licensing procedure under atomic energy law

The 7th Senate of the Federal Administrative Court has given a statement to the inquiring Federal Constitutional Court, concerning the legal problems in connection with an order given by the competent highest Federal authority to a highest Land authority within the scope of a nuclear licensing procedure. This statement of 24 April 1989 (7 ER 505/88) is given in full in this article, and has been delivered upon inquiry by the Fed. Constitutional Court of 14 December 1988, in matters of the case 2 BvG 1/88, nuclear power plant at Kalkar. The constitutional dispute arises out of differing opinions on the rights and obligations of the Federal authority and the authority of the Land North Rhine Westfalia in the implementation of Federal law and in execution of Federal supervisory powers.
