Topical problems of nuclear third party liability law as a consequence of the Chernobyl disaster
Description
The Chernobyl reactor accident and the consequences we had to cope with gave some hints as to the further development of the nuclear liability law, in order to enhance the protection of persons affected, and to make the necessary delimitation of the damage concept. The main items to be discussed include the building in of preventive measures into the liability provisions, the definition of the concept of damage, the volume of financial security, and the improvement of international nuclear liability system. Abstract (German)
Die Erfahrungen mit den Folgen des Reaktorunfalls in Tschernobyl haben wertvolle Hinweise fuer die Fortentwicklung des Nuklearhaftungsrechts mit dem Ziel einer Verbesserung des Schutzes der Geschaedigten und einer notwendigen Eingrenzung des Schadensbegriffs gebracht. Schwerpunkte sind die haftungsrechtliche Einordnung von Vorsorgemassnahmen, der Schadensbegriff, die Hoehe der Deckungsvorsorge und die weitere Verbesserung der internationalen Haftungssysteme.
