Description
After having recalled the French legal framework related to radiation protection, the author reports and discusses a case which illustrates what is at stake for an employer in terms of radiation protection; and also the importance of the concept of safety obligation of result which appeared for the compensation of victims of asbestos. Here, the case concerns a man who has been working in a base nuclear installation operated by EDF, and who developed a cancer which has been acknowledged as a professional disease. The author outlines some aspects of the case which could make one think of a non-responsibility of the company. He analyses the decision taken by the Court, discusses the consequences for companies of the nuclear sector, and outlines the important role of the expert in radiation protection
