Description
The paper discusses the question of how the EURATOM property in special fissionable materials as specified in article 86 of the EURATOM treaty has to be treated by German law and which effects the decisions to be made will then have on the borrowing of money by nuclear power plant operators as well as on the collateral for this borrowed money. It is mandatory for all parties to reach a consensus of opinion regarding these matters in order to guarantee a legally irreproachable collateral for the money to be borrowed. The influencing factors from the fields of civil, public, and international law will have to be coordinated in consideration of the powers of the EURATOM community. (HP/AK)
Abstract (German)
Es wird die Frage diskutiert, wie das in Art. 86 EURATOM-Vertrag erwaehnte Eigentum der EURATOM-Gemeinschaften an besonderen spaltbaren Stoffen nach deutschem Recht zu betrachten ist, und welchen Einfluss die dann zu treffenden Entscheidungen auf die Fremdmittelaufnahmen der KKW-Betreiber und auf die Besicherung dieser Fremdmittel haben. Zwingend erforderlich ist es dabei, eine einheitliche Meinung aller Beteiligten herzustellen, um die Besicherung der aufzunehmenden Fremdmittel in juristisch einwandfreier Form zu gewaehrleisten. Die sich ergebenden Einflussfaktoren aus den Bereichen des buergerlichen, oeffentlichen und internationalen Rechts muessen unter Beachtung der Befugnisse der EURATOM-Gemeinschaft aufeinander abgestimmt werden.
