Can an application for shut-down of a nuclear power plant be successful on the grounds that the Chernobyl fallout enhances the local radiation exposure?

A neighbour of a nuclear power plant in the FRG who, as a result of the fallout from the Chernobyl reactor accident, is affected by higher levels of radioactive radiation in the environment cannot claim the power plant to be shut down simply on the grounds that the radioactivity release from the power plant slightly enhances the total exposure. This also applies to the situation where the limits defined in section 45 of the Radiation Protection Ordinance are exceeded. (orig.)
Abstract (German)
Der infolge des Reaktorunfalls von Tschernobyl einer erhoehten radioaktiven Strahlung ausgesetzte Nachbar eines deutschen Kernkraftwerkes kann die Stillegung dieses Kraftwerkes nicht schon deswegen verlangen, weil es durch die genehmigten Radioaktivitaetsabgaben geringfuegig zu der Gesamtbelastung beitraegt. Das gilt auch dann, wenn durch diese Belastung die Grenzwerte des Paragraphen 45 StrlSchV deutlich ueberschritten werden. (orig.)Additional details
