The so-called 'preliminary approval' in the nuclear licensing procedure - is it an admissible instrument of administration?

The article discusses the current proceeding of the Alkem case: the prosecution says the instrument of preliminary approval is unlawful. The author first defines the respective functions of preliminary approval and preliminary licence as set out in sec. 7 Atomic Energy Act. Upon examination of various aspects - including the rights of participation- he states the preliminary approval to be admissible in principle, however restricted in time, any preliminary approval necessarily to be replaced by a definite decision taken in due time by the procedure required by the law. Any person possibly affected by the nuclear installation in question who in the ordinary licensing procedure would have the right of participation must be given the right of action against the preliminary approval. Abstract (German)
Der Artikel bezieht sich auf den laufenden Alkem-Prozess: Nach Ansicht der Staatsanwaltschaft ist das Instrument der Vorabzustimmung rechtswidrig. Der Artikel grenzt zunaechst die Vorabzustimmung ab vom Vorbescheid nach Paragraph 7 AtomG. Nach Pruefung verschiedener Aspekte - auch der Beteiligungsrechte - ergibt sich die grundsaetzliche Zulaessigkeit der Vorabzustimmung. Sie darf aber nur solange rechtmaessigerweise aufrechterhalten bleiben, bis eine endgultige Entscheidung im normalen und zuegig betriebenen Genehmigungsverfahren moeglich waere. Dem potentiell Betroffenen und somit im formellen Genehmigungsverfahren Mitwirkungsberechtigten muss eine Klagebefugnis gegen die Vorabzustimmung zugebilligt werden. (HSCH)Additional details
