International and European regulations in the energy law: selected issues
Description
This work deals with four selected legal aspects or issues in the energy sector, which are mainly located in the international, European and at the interface to national law. The first question is 'The status of the investor to the Energy Charter' and addresses issues regarding the investor position and their characteristics according to the Energy Charter Treaty. The second question is 'aspects of energy competence under the Treaty of Lisbon' and deals among others questions with the new energy expertise offense, as well as direct investment. The third issue, titled 'The admissibility of ownership unbundling' illuminates terms of a proposal, which plan a full ownership unbundling of transmission system operators, in more detail. The fourth issue is 'aspects for the implementation of directive 2006/32/EC' and deals with aspects of the implementation of this directive in Austria. This work is making an attempt to shed light on these questions and their issues in more detail by also taking into account the Austrian perspectives. In my view the energy sector is an economically important and politically embossed area that always has a current relevance to daily life and will raise more legal questions in future. (kancsar)

Diese Arbeit beschaeftigt sich mit vier ausgewaehlten juristischen Aspekten bzw Fragestellungen im Energiebereich, welche vorwiegend im internationalen, europaeischen sowie an der Schnittstelle zum nationalen Recht angesiedelt sind. Die erste Fragestellung lautet 'Die Stellung des Investors nach der Energiecharta' und behandelt Aspekte hinsichtlich der Investorstellung und deren Besonderheiten nach der Energiecharta. Die zweite Fragestellung lautet 'Aspekte zur Energiekompetenz nach dem Vertrag von Lissabon' und beschaeftigt sich unter anderem mit dem neuen Energiekompetenztatbestand, sowie auch mit Direktinvestitionen. Die dritte Fragestellung mit dem Titel 'Die Zulaessigkeit des Ownership-Unbundlings' beleuchtet Regelungen eines Richtlinienvorschlags naeher, welcher eine vollstaendige eigentumsrechtliche Entflechtung von uebertragungsnetzbetreiber vorsah. Die vierte Fragestellung lautet 'Aspekte zur Umsetzung der Richtlinie 2006/32/EG' und beschaeftigt sich mit Aspekten der Umsetzung dieser Richtlinie in oesterreich. Diese Arbeit unternimmt den Versuch diese Fragestellungen und deren Problematiken naeher zu beleuchten und dabei auch jeweils oesterreichische Sichtweisen zu beruecksichtigen. Der Energiebereich ist, meiner Ansicht nach, ein volkswirtschaftlich wichtiger und politisch gepraegter Bereich, der stets einen aktuellen Bezug zum taeglichen Leben aufweist und auch in Zukunft vermehrt juristische Fragestellungen aufwerfen wird.
