Description
Technical developments can both change the methods of dealing with existing conflicts, and cause new conflicts. Meyer-Abich analyzes five conflicts caused by the technological development in the solution of which the constitutional, liberal, and democratic protection of fundamental rights is not at all guaranteed. Meyer-Abich thinks that these new conflicts can be solved in the framework of the liberal constitutional state, if legal and political consequences are taken in order to guarantee the uncharged protection of fundamental rights under changing conditions. The necessary reforms can, however, only be realized if the way how state and science see themselves changes. Both have to give up their one-sidedness into which have been pushed by conflict which havbe been caused by the scientific and technical development. Only then it will be possible to solve the jemerging conflicts without eopardizing the integritiy of the society. (orig.)
Abstract (German)
Technische Entwicklungen koennen sowohl die Formen des Austrags bestehender Konflikte veraendern als auch neue Konflikte hervorrufen. Meyer-Abich analysiert fuenf durch die technologische Entwicklung bedingte Konflikte, in deren Austrag der rechtsstaatlich liberal-demokratische Grundrechtsschutz nicht ohne weiteres gewaehrleistet ist. Meyer-Abich haelt diese neuen Konflikte im Rahmen des liberalen Rechtsstaats fuer loesbar, wenn rechtspolitische Konsequenzen gezogen werden, um den Grundrechtsschutz unter veraenderten Bedingungen unveraendert zu gewaehrleisten. Die notwendigen Reformen sind jedoch nur durchfuehrbar, wenn sich das Selbstverstaendnis von Staat und Wissenschaft aendert. Beide muessen ihre Einseitigkeit aufgeben, in die sie durch die Konflikte gedraengt wurden, welche die wissenschaftlich-technische Entwicklung hervorgerufen hat. Nur dann wird ein die Integritaet der Gesellschaft nicht gefaehrdender Austrag der aufgebrochenen Auseinandersetzungen moeglich sein. (orig./HSCH)Additional details
