Exclusion in licensing procedures under the Atomic Energy Act and under the Federal Act on Immission Control

The paper investigates in detail the legal effects of preliminary and partial licences for the construction of power plants or other large industrial plants, as far as these are of importance with regard to subsequent procedures for partial licences and other legal procedures under the law of neighbours in pursuance of section 10, subsection (3) and section 11 of the Federal Act on Immission Control (BImSchG) or in pursuance of section 7b of the Atomic Energy Act (AtG). The study is based upon a dogmatically comprehensive and consistent legal approach, leading to a consistent and constructive solution of the relevant legal problems by considering the interests of all parties concerned. Abstract (German)

Die Schrift untersucht im einzelnen die mit Vorbescheid und Teilgenehmigung von Kraftwerken und sonstigen industriellen Grossvorhaben verbundenen Rechtswirkungen, soweit sie fuer das nachfolgende Teilgenehmigungsverfahren und den immissionsschutzrechtlichen (Paragraph 10 Abs. 3, Paragraph 11 BImSchG) bzw. atomrechtlichen (Paragraph 7b AtG, Paragraph 7 Abs. 1 AtVfV) Nachbarrechtsprozess von Bedeutung sind. Der Arbeit liegt ein geschlossener rechtsdogmatischer Ansatz zugrunde, der es ermoeglicht, die einschlaegigen Rechtsfragen einer konstruktiv widerspruchsfreien und interessengerechten Loesung zuzufuehren.
