Description
Electricity transport consists in high or very high voltage transmission, from production areas to distribution zones. It is done by air, underground or underwater power lines. Electricity transport is an necessary activity to make public electricity service work properly. It plays an important role in the country's energy security and consequently can't be interrupted. However, its immense network (with lines adding up to more than 100 000 kilometers), cannot avoid confrontation with others interests. From the beginning, it is admitted that electricity transport infringes on private property. From the start, its legal status has been determined in agreement with that interaction. Nevertheless, it is now admitted that electricity transport also damages the environment. However, this status had already been determined by taking into account its potential damage to private property. It is not at all adapted to the apprehension of the environmental problems. As a consequence, the damages caused to Mankind and Environment by transporting electricity are difficult to repair (part I). Therefore, they must be avoided. Thanks to the environmental law, electricity transport tried, first constraint, then voluntarily, to modify its ways of operating and adapt them to environmental interests. Nevertheless, these measures are still far from being sufficient. Although Environment appears in all phases of the activity (from the design to the removal, including the way the structure works and the various modifications), the measures devoted to its protection remain superficial. Their efficiency is relative. Their integration into the whole system is not effective (part II). However, in the context of the predicted development of the electricity transmission network, it is necessary to question the need to change the paradigm and, for a better conciliation place, Environment in the center of the activity. Abstract (French)
Le transport d'electricite consiste en l'acheminement, a haute ou tres haute tension, du courant depuis les points de production aux zones de distribution. Il est realise au moyen de lignes electriques qui peuvent etre, aeriennes, souterraines et sous-marines. Le transport d'electricite est une activite necessaire au bon fonctionnement du service public de l'electricite. Il est un acteur de la securite energetique du pays et ne doit donc, a ce titre, pas etre interrompu. Toutefois, son principal outil, un immense reseau de plus de 100 000 kilometres de ligne, ne peut pas eviter la confrontation avec certains interets. Depuis son origine, il est admis que le transport d'electricite porte atteinte au droit de propriete. Son regime a donc ete, des l'origine, determine en fonction de cette interaction. Neanmoins, il est aujourd'hui admis que le transport d'electricite porte egalement atteinte a l'environnement. Or, son regime, deja determine en fonction du caractere necessaire et des atteintes portees a la propriete, n'est pas du tout adapte a l'apprehension des problematiques environnementales. Il en ressort que les dommages generes par l'activite de transport d'electricite a l'homme et a l'environnement sont difficiles a reparer (partie I). Il convient donc de les eviter. C'est avec les outils proposes par le droit de l'environnement que l'activite de transport d'electricite a essaye, d'abord contrainte puis volontaire, de modifier son fonctionnement et de l'adapter aux interets environnementaux. Neanmoins, ces mesures sont encore bien insuffisantes. Meme si l'environnement apparait dans toutes les phases de l'activite (de la conception a la depose du projet sans omettre le fonctionnement de l'ouvrage et ses modifications), les mesures consacrees a sa protection demeurent superficielles. Leur efficacite est relative. La conciliation n'est, des lors, pas effective (partie II). Or, dans l'optique d'un accroissement annonce du reseau de transport d'electricite, il y a lieu de s'interroger sur la necessite de changer de paradigme et de placer, aux fins d'une conciliation effective, l'environnement au coeur de l'activite.
