Consultation of an expert for establishing an analysis of the weak points of a fuel element plant

The consultation of an expert under Article 20 Clause 1 of the Atomic Energy Act only serves the purpose of preparing a decision on the merits. An order stating that commissioned experts be granted free access to a fuel element plant and assisted in their work is a procedural act under Article 44a Clause 2 of the Rules of the Administrative Courts and can be enforced. It is possible to seek relief specifically against such an order. Pursuant to Article 20 Clause 1 of the Atomic Energy Act, a surveillance procedure requires the supervisory authority empowered under atomic energy law to act appropriately at its own discretion. In doing so, the authority may consult several experts for the purpose of forming its own opinion on possible legally relevant dangers and risks relating to the installation by means of an examination of the weak points. Abstract (German)
Die Zuziehung von Sachverstaendigen im Sinne des Paragraphen 20 Satz 1 AtG dient lediglich der Vorbereitung einer Sachentscheidung. Die Anordnung, herangezogenen Sachverstaendigen das ungehinderte Betreten eines Brennelementewerkes zu ermoeglichen und diese Sachverstaendigen bei ihrer Taetigkeit zu unterstuetzen, ist eine Verfahrenshandlung im Sinne des Paragraphen 44a Satz 2 VwGO, die vollstreckt werden kann. Dagegen koennen Rechtsbehelfe gesondert geltend gemacht werden. Im Aufsichtsverfahren nach Paragraph 20 Satz 1 AtG hat die atomrechtliche Aufsichtsbehoerde nach pflichtmaessigem Ermessen zu handeln. Der Behoerde steht es dabei frei, mehrere Sachverstaendige heranzuziehen, um sich durch eine Schwachstellenanalyse ein Urteil ueber etwa bestehende rechtserhebliche Gefahren und Risiken, die mit einer Anlage verbunden sind, zu bilden.
