In its decision of April 29, 1987, the Bavarian Constitutional Court dismisses the action against the development plan of the reprocessing plant at Wackersdorf. The town of Nuernberg is not encroached in its constitutional rights according to art. 11 para. 2 Bavarian Constitution by the transport of radioactive waste within its municipal area after the commissioning of the reprocessing plant. Abstract (German)
In der Entscheidung vom 29.04.87 hat der Bayerische Verfassungsgerichtshof die Klage gegen den Bebauungsplan fuer eine Wiederaufbereitungsanlage abgelehnt. Die Stadt Nuernberg werde durch den Transport radioaktiver Stoffe auf ihrem Gemeindegebiet nach Inbetriebnahme der Wiederaufbereitungsanlage nicht in ihren verfassungsmaessigen Rechten aus Art. 11 Abs. 2 Bayerische Verfassung verletzt.
