Legal channelling and contractual liability for damages
Description
In practice, when disposing of radioactive material, if an unexpected nuclear incident occurs and this leads to damages to persons and material goods, then disputes between the disposal partners as to compensation for damages can arise, and thereby also legal points of contact between strict liability under nuclear law and liability based on fault under contractual law. In order to clarify this problem, the paper analyses a case occurring within the territories of the FRG, and thereby illustrates the ''two-track approach'' of the (tortious and contactual) law of damages in the field of the peaceful utilization of nuclear energy. Abstract (German)
In der Praxis kann es bei der Entsorgung von radioaktivem Material dann zu Schadensersatzdiskussionen zwischen den Entsorgungspartnern und damit zugleich zu rechtlichen Beruehrungspunkten zwischen der atomrechtlichen Gefaehrdungshaftung und der vertragsrechtlichen Verschuldungshaftung kommen, wenn wider Erwarten ein nukleares Ereignis eintreten und dieses Sach- und Personenschaeden zur Folge haben sollte. Zur Verdeutlichung wird ein, auf dem Gebiet der Bundesrepublik Deutschland anzusiedelnder Fall analysiert, an dem die ''Zweigleisigkeit'' des (deliktischen und vertragsrechltichen) Schadensersatzrechts im Bereich der friedlichen Nutzung der Kernenergie aufgezeigt wird.
