Federal Administrative Court refused to declare the first partial license of the Muelheim-Kaerlich reactor null and void

Description
In its decision of July 17, 1980, the Federal Administrative Court dismissed the appeal lodged by an appelant against the dimissal by the Supreme Administrative Court concerning the nullity of the first partial licence for the Muelheim-Kaerlich reactor as being unfounded. In doing so, the issue of nullity has been marked off from the issue of foreclosure of demurers. The amount in ligitation was fixed at 20000 DM for the proceedings of appeal. (HSCH)
Abstract (German)
Mit Urteil vom 17.7.1980 hat das Bundesverwaltungsgericht die Revision einer Klaegerin gegen das klagabweisende Urteil des Oberverwaltungsgerichts wegen Nichtigkeit der 1. Teilgenehmigung fuer das KKW Muelheim-Kaerlich als unbegruendet zurueckgewiesen. Dabei wurde die Nichtigkeit von der Frage der Praeklusion von Einwendungen abgegrenzt. Der Streitwert fuer das Revisionsverfahren wurde auf 20.000,-- DM festgesetzt. (HSCH)Additional details
