New legal aspects of radioactive waste disposal

After a short survey on the constitutional discussion of radioactive waste disposal, which it is true has not yet come to an end but is more or less cleared up, legal questions of radioactive waste disposal are discussed for four sectors: 1. the licensing possibilities of compact and intermediate storage facilities for spent fuel elements, 2. provisions for radioactive waste disposal as a condition for license, 3. the relation of nuclear-legal standards to other regulations under public law in the field of radioactive waste disposal, 4. the regulation of radioactive waste disposal in the future Radiological Protection Ordinance. Abstract (German)

Nach einem kurzen Ueberblick ueber die verfassungsrechtliche Diskussion der Entsorgung, die zwar noch nicht abgeschlossen aber weitgehend vorgeklaert ist, werden Rechtsfragen der Entsorgung fuer 4 Bereiche diskutiert: 1. die Genehmigungsfaehigkeit von Kompakt und Zwischenlagern fuer abgebrannte Brennelemente. 2. Entsorgungsvorsorge als Genehmigungsvoraussetzung, 3. das Verhaeltnis atomrechtlicher Normen zu anderen oeffentlich-rechtlichen Genehmigungsvorschriften im Bereich der Entsorgung, 4. die Entsorgungsregelung in der kuenftigen Strahlenschutzverordnung.
