No halt to the construction of Muelheim-Kaerlich nuclear power station

The grounds upon which the judgment of Koblenz Administrative Court (Verwaltungsgericht) of 1-8-1975 - 7 L 14/75 - was based are now available. In this decision, the action of the city of Neuwied for restitution of the action to set aside (motion to stay the immediate execution of) the First Partial License for the construction of the 1,200 MW nuclear power station at Muelheim-Kaerlich was dismissed. The costs of the administrative procedures, including the extra-judicial costs of the persons summoned to appear in court, are imposed upon the applicant. The value in litigation of the procedures following the motion to stay proceedings was fixed at 50,000 DM. The sometimes contradictory grounds of paragraph II are given in full wording and commented upon. (orig./AK)

Zu dem Beschluss des Verwaltungsgerichts Koblenz vom 1.8.1975 - 7 L 14/75 -, durch den der Antrag der Stadt Neuwied auf Wiederherstellung der aufschiebenden Wirkung der Anfechtungsklage (Aussetzung der sofortigen Vollziehung) gegen den ersten Teilgenehmigungsbescheid fuer die Errichtung des 1.200 MW-Kernkraftwerks Muelheim-Kaerlich abgelehnt wurde, liegen jetzt die Entscheidungsgruende vor. Die Kosten des Verfahrens, einschliesslich der aussergerichtlichen Kosten der Beigeladenen, wurden der Antragstellerin auferlegt. Der Streitwert fuer das Aussetzungsverfahren wurde auf 50.000 DM festgesetzt. Die zum Teil widerspruechlich erscheinenden Entscheidungsgruende des Absatzes II werden im Wortlaut wiedergegeben und kommentiert. (orig./HP)Additional details
