The interpretation of the concept of public interest as used in section 4, sub-section 2 of the German Energy Act (EnWG) is of prime importance to the procedure of prohibition in matters subject to the EnWG. The content of the term 'public interest' used in this Act which came into force in 1935 has been subject to developments leading to change of definition, and the energy policy controversy of the 1970s was not the first event to open up discussions about the meaning of this term. This term of a general nature has always created difficulties in working out its concrete content and effects in practice. The work in hand is intended to explain the concept of public interest as used in section 4, sub-section 2 EnWG by way of the methodology of legal science, showing the connection between the rule of law and methodology on the one hand and development of the law on the other. Abstract (German)
Die Auslegung des Gemeinwohlbegriffs in Paragraph 4 Abs. 2 EnWG ist von zentraler Bedeutung fuer das energiewirtschaftsrechtliche Untersagungsverfahren. Der Gemeinwohlbegriff des 1935 verabschiedeten EnWG unterliegt dabei nicht erst seit den energiepolitischen Kontroversen der 70er Jahre einem gewandelten Verstaendnis. Als generalklauselartiger Begriff begegnet er im Spannungsverhaeltnis zum rechtsstaatlichen Bestimmtheitsgebot Schwierigkeiten bei seiner praktischen Konkretisierung. Ziel der Arbeit ist die Eingrenzung der Auslegung des Gemeinwohlbegriffs in Paragraph 4 Abs. 2 EnWG anhand der rechtswissenschaftlichen Methodenlehre. Dabei wird der enge Zusammenhang zwischen Rechtsstaatlichkeit und Methodenlehre fuer die Rechtsfortbildung aufgezeigt. (orig.)Additional details
