Constitutional relevance of atomic energy law

Description
In a decision publicized on December 20, 1979 the German Federal Constitutional Court rejected a claim of unconstitutionality in connection with the licensing procedure of the Muelheim-Kaerlich Nuclear Power Station currently under construction. This constitutes confirmation, by the 1st Department of the Court, of a decision in 1978 by the 2nd Department about the Kalkar fast breeder power plant, in which the peaceful utilization of nuclear energy had been found to be constitutional. However, the new decision by the Federal Constitutional Court particularly emphasizes the constitutional relevance of the rules of procedure under the Atomic Energy Act and their function with respect to the protection of civil rights. Abstract (German)
Das Bundesverfassungsgericht hat mit seinem Beschluss zu einer Verfassungsbeschwerde gegen das Kernkraftwerk Muelheim-Kaerlich zum zweiten Mal eine atomrechtlich relevante Entscheidung getroffen. Dabei hat der erste Senat die Grundsatzentscheidung des zweiten Senats im sog. Kalkar-Beschluss bestaetigt, dass die friedliche Nutzung der Kernenergie mit dem Grundgesetz vereinbar ist. Er hat dabei jedoch die verfassungsrechtliche Relevanz der atomrechtlichen Verfahrensvorschriften und ihre grundrechtschuetzende Funktion besonders hervorgehoben. (orig.)Additional details
