The environmental impact statement and the relationship between official approvals of a plan and licensing decisions within the system of law

Description
The implementation of the Council Directive concerning the environmental impact assessment involves considerable difficulties. The author's opinion is that environmental concerns have also to be regarded in the way of interpretation of indeterminate legal concepts in cases of licensing procedures. For the choice of site, for example, public interest are assessed pursuant to section 7 II No. 6 of the Atomic Energy Act. (CW)

Die Umsetzung der Umweltvertraeglichkeitsrichtlinie ist problematisch. Der Autor meint, bei Genehmigungsverfahren sollten Umweltbelange auch bei der Auslegung unbestimmter Gesetzesbegriffe beruecksichtigt werden. Zum Beispiel werden fuer die Wahl eines Standortes oeffentliche Interessen gemaess Paragraph 7 II Nr. 6 Atomgesetz beurteilt. (CW)Additional details
