Aspects of the development of the law relating to licensing of nuclear power plants

Description
The author of the analysis of developments in Germany over a period of thirty years states that he cannot help feeling that the decisions for or against nuclear power plant licensing taken in the past in many cases have been more guided by the then current degree of political acceptance of the peaceful uses of nuclear energy than by the substantive legal principles and laws governing nuclear power plant licensing. This view is explained by discussing some examples of the licensing practice and by analysing some important legal terms and their interpretation and application in the course of the licensing history. Der Autor dieser Analyse der Entwicklungen ueber einen Zeitraum von dreissig Jahren kann sich prinzipiell kaum des Eindrucks erwehren, dassdie Entscheidungen ueber die Genehmigung von Atomanlagen oft mehr vom jeweiligen Grad der Akzeptanz der friedlichen Nutzung der Kernenergie gepraegt wurden als von den normativen Grundlagen des atomrechtlichen Genehmigungsrechts. Er erlaeutert diese Auffassung anhand von Beispielen aus der Genehmigungspraxis und der Untersuchung einiger juristischer Begriffe und deren Auslegung and Anwendung. (CB)Additional details
