Risk in environmental law - competence, procedure and standards for evaluation

Description
Environmental law can often only be enforced by environmental standards. Expecially undeterminate legal terms, which describe a certain environmental condition need being put in concrete terms. It is very important therefore, who establishes technical rules, standards and measuring methods (e.g. 30 mrem/a in the Radiation Protection Ordinance), and in which procedure this can be done. For the control by administrative courts the basis of these decisions should be available. (CW)

Umweltrecht kann oft nur durch Umweltstandards durchgesetzt werden. Vor allem unbestimmte Rechtsbegriffe, die einen bestimmten Umweltzustand beschreiben, benoetigen diesen Prozess der Konkretisierung. Es ist deshalb sehr bedeutsam, wer und in welchem Verfahren technische Regeln, Standards und Messmethoden (z.B. 30 mrem/Jahr in der Strahlenschutzverordnung) festlegen kann. Fuer die verwaltungsgerichtliche Kontrolle sollte eine Grundlage fuer diese Entscheidungen verfuegbar sein. (CW)Additional details
