Liability aspects of nuclear materials transports

The author refers to the relevant legal provisions of the Paris Convention and the Federal German Atomic Energy Act and against this background discusses the problem of who is to made liable for what. He discusses aspects such as assumption of liability as an act of collateral promise, and division of liability between nuclear installation owners at home and abroad. The article furthermore deals with provisions and models for a concentration of liability, aspects of jurisdiction, financial security and third party liability insurance, and scope and upper limits of coverage, and indemnification furnished by the state pursuant to section 34 Atomic Energy Act.
