Partial licence under the Atomic Energy Act and the requirement to furnish evidence of provisions for waste management

Revocation is the only legal means applicable to terminate the binding force of final decisions set fotth in a nuclear partial licence (construction licence) in view of decisions to be taken in the course of the licensing procedure (here: decision on the operating licence for the Brokdorf reactor), if the factural situation has changed and requires modified assessment. The licence under review by the court could not be devised on the grounds that there was no spent fueld repository available at the time the decision was taken to grant an operating licence, i.e. in 1988.
