A view on practical application conditions of international order for nuclear civil liability, applied to nuclear accident in Europe

This paper analyzes the application conditions of nuclear civil liability, in Europe, after a nuclear accident. Several scenarios are imagined: accident in nuclear power plant, transport accident or fire in a ship. Then, the author describes the establishment of safeguard measures, the rehabilitation measures and legal aspects of requisitions, victims and workmens compensations or indemnification agreements. In the last part, this paper shows some application problems of international agreements on nuclear liability (Vienna Convention on Civil Liability for Nuclear damage, Paris Convention on Third Party Liability). 61 refs., 2 appendices
