Dortmund Regional Court: Decision of October 10, 1980 - on the boycotting of electricity rate payments

Generating electricity which is to be supplied in a certain way, for instance, without utilizing nuclear energy, does not form part of the main obligations of an electricity supply utility. In view of the claim of the electricity supply utility for payment, the client has no right of refusal to pay and no right to withhold payment of rates with regard to future electricity supplies on the grounds of electricity supply being generated in whole or in part in nuclear power stations for the operation of which the authorities have granted a licence. If electricity rates have been reduced illegally or if a reduction has been announced, the electricity supply utility has the right to make use of its right to shut off electricity if the client intends to withhold payment permanently.
