Peaceful uses of nuclear energy and state frontiers in Central Europe

The German division of the International Nuclear Law Association (INLA) dedicated its regional conference 1986 in the town of Regensburg to the legal problems created by transfrontier effects of the peaceful uses of nuclear energy. The participants also discussed the Chernobyl reactor accident and its effects on Central Europe from the point of view of the law. The main subjects dealt with refer to problems of preventive protection and the compensation for damage by means of a suitable liability regime. The papers presented at the three sessions discuss legal problems of transfrontier site planning, the legal position of citizens of neighbouring states with regard to national licensing procedures, transfrontier aid and assistance in case of emergencies, international law obligations of the licensing state in case of incidents or accidents, definition of standards and dose limits for radiation accidents, regulations for the protection of the seas and inland waterways against radioactive contamination, and selected problems of international nuclear liability law. All 23 conference papers are separately analysed and recorded in the database. (orig./HP)

Die Deutsche Landesgruppe der International Nuclear Law Association (INLA) hat auf ihrer Regionaltagung 1986 in Regensburg Rechtsprobleme eroertert, die sich aus den grenzueberschreitenden Wirkungen der friedlichen Kernenergienutzung ergeben. Dabei wurden auch die Erfahrungen, die der Reaktorunfall in Tschernobyl fuer Mitteleuropa erbracht hat, einer ersten rechtswissenschaftlichen Analyse unterzogen. Es wurden Probleme des praeventiven Schutzes und des schadensausgleichenden Haftungsrechts untersucht. Grenzueberschreitende Standortplanung, Beteiligung von Auslaendern an inlaendischen Genehmigungsverfahren, internationale Hilfe bei Stoer- und Unfaellen, voelkerrechtliche Verpflichtungen des Genehmigungsstaates bei Unfaellen, Festsetzung von Richtwerten und Grenzwerten bei Strahlenunfaellen, Regelungen zum Schutz des Meeres und der Binnengewaesser vor radioaktiver Kontamination sowie ausgewaehlte Probleme des internationalen Atomhaftungsrechts waren Diskussionsthemen.
