Act No 83-630 of 12 July 1983 concerning democratization of public enquiries and protection of the environment

Description
Henceforth separated from expropriation procedures, public enquiries have become compulsory for any plans, achievements or work likely to affect the environment because of their type, consistence or nature of the areas involved. Lists of operations subject to procedures, thresholds and technical criteria will be determined by decrees made in the Council of State. The purpose of the enquiry is to inform the public and obtain its suggestions. The enquiry is conducted by a Commissioner or a Commission whose independence is guaranteed vis-a-vis the constructor concerned. (NEA)

Desormais dissociees de la procedure d'expropriation, les enquetes publiques deviennent obligatoires pour tous amenagements, ouvrages ou travaux susceptibles d'affecter l'environnement en raison de leur nature, de leur consistance ou du caractere des zones concernees. Des listes d'operations soumises a la procedure, des seuils et des criteres techniques seront definis par decrets en Conseil d'Etat. Le but de l'enquete est d'informer le public et de recueillir ses suggestions. L'enquete est conduite par un Commissaire ou par une Commission, dont l'independance vis-a-vis du maitre d'ouvrage est assureeFiles
