Legal questions relating to Federal final deposits for radioactive waste

Radioactive waste has to be disposed of in a safe way. This is according to the Nuclear Energy Act for the Federal Republic of Germany a task of the state. The Government has to take care of final depositing; it is obliged by law to install and to operate appropriate facilities. Concerning the principles of start-up operations, essential alterations in Federal final deposits, and in particular also regarding state supervision, questions arise which are not always easy to solve in legal practice and which, thus, require clarification. Proposals are made with a view to this. For instance, regarding supervision during the operational phase, the stance is taken that state control pursuant to section 19 AtomG should not be carried out by a high Land authority within the framework of delegated Federal administration, but in self-supervision by the Federal Office for Radiation Protection, the central Federal authority responsible for the installation and operation of Federal final deposits (section 87 subsection 3 GG), under the control of the Government (BMU (Federal Ministry for Environment, Nature Protection and Reactor Safety)) within the framework of Federal self-administration. Abstract (German)
Radioaktive Abfaelle muessen sicher beseitigt werden. Nach dem Atomgesetz fuer die Bundesrepublik Deutschland handelt es sich dabei um eine staatliche Aufgabe. Fuer die Endlagerung hat der Bund zu sorgen; er ist gesetzlich verpflichtet, entsprechende Anlagen zu errichten und zu betreiben. Zu den Grundlagen der Betriebsaufnahme, fuer wesentliche Aenderungen der Bundesendlager und insbesondere auch hinsichtlich der staatlichen Aufsicht ueber ihren Betrieb stellen sich die Fragen, die bei der Rechtsanwendung nicht immer leicht zu loesen sind und deshalb der Klaerung beduerfen. Dazu werden Vorschlaege unterbreitet. Es wird z.B. zur Aufsicht waehrend der Betriebsphase die Auffassung vertreten, dass nicht die in Paragraph 19 AtomG geregelte staatliche Aufsicht durch eine oberste Landesbehoerde im Rahmen der Bundesauftragsverwaltung durchzufuehren ist, sondern dass das Bundesamt fuer Strahlenschutz als die fuer die Errichtung und den Betrieb von Bundesendlagern zustaendige Bundesoberbehoerde (Art. 87 Abs. 3 GG) eine Eigenueberwachung vorzunehmen hat, beaufsichtigt vom Bund (BMU) im Rahmen bundeseigener Verwaltung.
