Legality of Decree authorizing the French Atomic Energy Commission to set up a subsidiary company

Description

This note on French case-law concerns a judgment by the Council of State (Conseil d'Etat) at the suit of the National Union of Nuclear Energy Personnel. This suit contested the legality of a Decree of 26 December 1975 authorizing the Atomic Energy Commission to set up a subsidiary company (COGEMA) to carry on industrial activities connected with the nuclear fuel cycle, as well as that of the Decree of 4 March 1976 approving the Statute of the subsidiary company. The judgment of the Council of State confirmed the legality of the 1975 Decree but repealed in part the provisions of the 1976 Decree. (NEA)

Abstract (French)

La presente note de jurisprudence francaise concerne une decision rendue par le Conseil d'Etat a la requete du Syndicat national du personnel de l'energie nucleaire. Cette requete contestait la legalite d'un Decret du 26 decembre 1975 autorisant le Commissariat a l'energie atomique a creer une societe filiale (la COGEMA) en vue d'exercer des activites industrielles dans le cadre du cycle du combustible nucleaire, ainsi que le Decret du 4 mars 1976 approuvant les statuts de cette filiale. La decision du Conseil d'Etat a confirme la legalite du Decret de 1975 et a en revanche annule en partie les dispositions du Decret de 1976
