Fuel storage pools in nuclear power plants: not eligible for licensing

Description

Basic problems in the interpretation and application of Atomic Law are discussed. Fuel storage pools are found to be eligible for licensing according to Sect. 7 of the Atomic Energy Act, independent of the requirement of recycling radioactive residual materials as stated in Sect. 9a, paragraph 1, No. 1 of the Atomic Energy Act. There is no gap in West German Atomic Energy Law. (orig.)

Abstract (German)

Die Untersuchung klaert grundsaetzliche Fragen bei der Auslegung und beim Vollzug des Atomgesetzes und kommt zu dem Ergebnis, dass Kompaktlager fuer abgebrannte Brennelemente in Kernkraftwerken nach Paragraph 7 AtG genehmigungsfaehig sind, und zwar unbeschadet der im Rahmen der 'Entsorgung' begruendeten Verwertungspflicht fuer radioaktive Reststoffe nach Paragraph 9a Abs. 1 Nr. 1 AtG. Eine Gesetzesluecke weist das deutsche Atomrecht fuer Kompaktlager nicht auf. (orig.)
