Application of the Vienna Convention and the implementation at worldwide level of nuclear liability principles
Description
This paper analyses the distinction between the status of the Vienna Convention and the status of the incorporation of the Convention's principles in national laws. Ten countries are Parties to the Vienna Convention, three others have signed it (only one of which could become a Party in the short term) and only two have established legislation. In such circumstances, and for the future, any analysis should be expanded to encompass the present and potential difficulties of the nuclear industry which has been particularly affected by the world economic and financial crisis. Also, a better understanding of the basic differences between the majority of countries which are potential parties to the Vienna Convention and the countries parties to the Paris Convention should be attained by a study on a case-by-case basis. La presente communication analyse la distinction entre le bilan de l'etat actuel de la Convention de Vienne et le bilan de l'incorporation des principes de la Convention dans les legislations nationales. Dix pays sont parties a la Convention de Vienne, trois l'ont signee (dont un seulement pourrait devenir partie a court terme) et deux seulement ont elabore une legislation. Dans ces circonstances, et pour l'avenir, il convient d'elargir l'analyse aux difficultes actuelles et potentielles de l'industrie nucleaire, particulierement touchee par la crise economique et financiere mondiale. Il faut aussi comprendre exactement, en les etudiant cas par cas, les inegalites fondamentales entre la majorite des pays qui sont des parties potentielles a la Convention de Vienne et les pays qui ont adhere a la Convention de ParisAdditional details
