EURATOM Treaty and European Internal Market
Description
A brief survey of the main operative chapters of the EURATOM Treaty already reveals that this Treaty, 30 years prior to the Single Act taking effect, has anticipated substantial elements of the Internal Market. The lecture deals with definitions in the EURATOM and EEC Treaty and with questions relating to practical examples from legislation in the field of energy. With the Commission's report 'The Internal Market for Energy' of May 1988 stock was taken of existing obstacles on the energy sector. In Annex V this document deals with the situation of nuclear energy and identifies problems on the market for installations and components, in particular on account of the different national systems regarding construction and safety standards. Schon ein kurzer Ueberblick ueber die wesentlichen operativen Kapitel des EURATOM-Vertrages zeigt, dass dieser Vertrag schon 30 Jahre vor Inkrafttreten der Einheitlichen Akte wesentliche Elemente des Binnenmarktes vorweggenommen hat. Das Referat behandelt Fragen der Abgrenzung im Einzelfall zwischen EURATOM- und EWG-Vertrag sowie Fragen der Praxis auf energierechtlichem Gebiet. Erst mit dem Bericht der Kommission 'Der Binnenmarkt fuer Energie' vom Mai 1988 erfolgte eine erste Bestandsaufnahme der bestehenden Hindernisse auf dem Energiesektor. In seinem Anhang V befasst sich dieses Dokument speziell mit der Situation der Kernenergie und identifiziert Probleme beim Markt fuer Anlagen und Bauteile, insbesondere aufgrund unterschiedlicher nationaler Systeme bei den Bau- und Sicherheitsnormen.
