Legal protection under environmental protection

Description
In the author's opinion, legal environmental protection in the Federal Republic of Germany has in general proved successful. Concerning the right of action in case of the construction of large-scale installations according to the Atomic Energy Act, the crucial decision was the distinction between individual and general risk for the population regarding the nuclear power plant 'Stade'. There remain, however, problems regarding the increasing extent of reasons of the judgement (Wyhl), the right of action on the part of foreign neighbours and the preliminary legal protection. (CW)
Abstract (German)
Der Autor ist der Ansicht, dass sich der Umweltrechtsschutz in der Bundesrepublik Deutschland grundsaetzlich bewaehrt hat. Hinsichtlich der Klagebefugnis beim Bau von Grossanlagen gemaess dem Atomgesetz fand die wichtige Entscheidung mit der Unterscheidung zwischen Individual- und allgemeinem Bevoelkerungsrisiko statt. Probleme bestehen noch bezueglich des wachsenden Umfangs von Urteilsbegruendungen (Wyhl), bei der Klagebefugnis von Auslaendern und beim vorlaeufigen Rechtsschutz. (CW)Additional details
