Nuclear indemnity legislation in the United States

Description

The United States legislation on the third party liability of operators of nuclear installations is contained in the Atomic Energy Act of 1954 and is generally known as the Price-Anderson Amendment. This amendment is due to expire on 1 August 1977. Therefore the Federal authorities have submitted to Congress a Bill containing new provisions on third party liability which take account of nuclear developments during these past years. The new system proposed retains the main features of the present provisions while providing for gradual phasing out of Government indemnity to be replaced by contributions from the nuclear industry; it also plans extension of financial protection to certain nuclear incidents occurring outside US territorial limits. The present limitation of liability for nuclear damage ($ 560 million) will be raised progressively as additional private funds are available. After being considered and adopted by Congress, the Bill was vetoed by the President on constitutional grounds. It must therefore be submitted again to Congress after it is revised

Abstract (French)

La legislation des Etats-Unis d'Amerique en matiere de responsabilite civile des exploitants d'installations nucleaires est contenue dans la Loi de base de 1954 sur l'energie atomique et est generalement designee sous le nom d'amendement Price-Anderson. La validite de cette legislation doit expirer le 1er aout 1977. C'est la raison pour laquelle les Autorites federales ont presente au Congres un projet de loi contenant de nouvelles dispositions en matiere de responsabilite civile nucleaire, qui tiennent compte de l'evolution des activites nucleaires au cours de ces dernieres annees. Le nouveau regime propose consiste a maintenir l'essentiel des dispositions actuelles tout en prevoyant une elimination progressive de l'indemnisation par le Gouvernement federal et son remplacement par des contributions de l'industrie nucleaire; il envisage egalement une extension de la garantie financiere a certains accidents nucleaires survenus en dehors des limites territoriales des USA. Le montant actuel de limitation de responsabilite pour les dommages nucleaires (560 millions de dollars) pourra etre eleve au fur et a mesure que des fonds prives supplementaires seront disponibles. Ce projet apres avoir ete discute et adopte par le Congres, a fait l'objet d'un veto presidentiel en raison d'une objection d'ordre technique. Il doit donc etre presente a nouveau au Congres apres modification
