Legal points of view on the industrial use of nuclear energy

The acknoweldgement of the connection between the use of fossile energy, the greenhouse effect and climatic changes has led to a reconsideration of political positions on energy. If the outcome of the re-assessment indicates that nuclear energy represents an important form of energy use for the foreseeable future, then the question of requirements for and structure of the decisions necessary for the licensing and operation of nuclear installations takes on new pungency. It has mainly to do with the significance of the political consensus on energy and the need for consensus-forming processes as a prerequisite for the continuance of nuclear energy use. A detailed explanation is given of the subjects of a necessary consensus and conditions for the formation of a consensus including a thorough reform of the licensing of nuclear installations. Abstract (German)
Die Erkenntnis des Zusammenhangs von fossiler Energienutzung, Teibhauseffekt und Klimaveraenderungen hat zu einem Ueberdenken der energiepolitischen Positionen gefuehrt. Wenn sich als Ergebnis der Neubewertung herausstellen sollte, dass die Kernenergie fuer eine absehbare Zukunft keine auslaufende Form der Energienutzung bedeutet, stellt sich die Frage nach Voraussetzung und Struktur der fuer die Zulassung und den Betrieb kerntechnischer Anlagen zu treffenden Entscheidungen mit neuer Schaerfe. Dabei geht es vor allem um die Bedeutung des energiepolitischen Konsenses und die Notwendigkeit konsensbildender Prozesse als Voraussetzung einer Fortsetzung der Kernenergienutzung. Die Gegenstaende eines notwendigen Konsenses und Bedingungen der Konsensbildung unter Einschluss einer grundlegenden Reform der Zulassung kerntechnischer Anlagen werden eroertert.
