Generic aspects of pollutant management

Comparing the legal provisions concerning wastes under the Atomic Energy Law, with those under the Waste Law, there are parallels: The mandatory regulation of reycling is applicable to both areas. Following that mandatory recycling regulation, the reprocessing of spent fuels remains an essential part of the Federal Government's concept of waste management. However, a major difference between the two legal areas is that the responsibility for establishing and operating ultimate storages for radioactive wastes does not lie with a public corporation competent under the law of a Land, but with the Federal Government. With the projects 'Konrad' and 'Gorleben' the Federal Government as the planner and builder meets its legal obligation. Delays and the negative judgement by the public are regretted. (orig./HSCH)
