Legal aspects of radioactive waste disposal

In consideration of the increase of radioactive waste in the near future, deficiencies and shortcomings of nuclear energy licensing and control are pointed out in a review of the present legislation on radioactive waste disposal. Above all, the present lack of an objective definition and of compulsory direct delivery or compulsory federal custody of radioactive waste are criticized. A clearly defined licensing procedure is also necessary for the disposal of spent nuclear fuels, which, according to the Atomic Energy Law, are subject to strict international control. Although some immediate improvements of the administrative regulations are possible, a comprehensive system for the disposal of radioactive wastes with adequate legal and organizational structures is deemed necessary for the future.
