The publication springs from a study 'Nuclear Power Enterprise in the Legal Order of the United States'. It is not its object to give a comprehensive view of atomic law in the USA; individual selcted problems, mainly of economic/judicial significance, are to be dealt with in order to give the German economic lawyer and expert access to this special material. An attempt is made not to stop at a non-critical rendering of the provisions of the Atomic Energy Act and the implementing regulations contained therein, but to see American nuclear law within the framework of the role the legislator wanted it to have in the first place, and to evaluate it in this context: Promotion and regulation of a branch of the energy industry which has an effect on the overall industry, and which has experienced in latter years a brisk upward movement as well as a rough period of crisis. The Energy Reorganization Act of 1974 is taken into account. It was the basis for dissolving the Atomic Energy Commission at the beginning of 1975, and for transferring its functions to the succeeding organizations 'Energy Resaerch and Development Administration' and 'Nuclear Regulatory Commission'. Die Arbeit ist aus einer Studie 'Nuclear Power Enterprise in the Legal Order of the United States' hervorgegangen. Ihr Gegenstand ist nicht die geschlossene Darstellung des Atomenergierechts der Vereinigten Staaten, sie will einzelne ausgewaehlte Probleme von vorwiegend wirtschaftlicher Tragweite abhandeln und dabei vor allem dem deutschen Wirtschaftsjuristen und Wirtschaftspraktiker Zugang zu dieser Spezialmaterie eroeffnen. Es wird versucht, nicht bei der unkritischen Widergabe der Vorschriften des Atomic Energy Act und der ihn ausfuellenden Durchfuehrungsverordnungen stehen zu bleiben, sondern das amerikanische Atomenergierecht im Rahmen der ihm vom Gesetzgeber primaer zugedachten Rolle zu sehen und zu werten: Foerderung und Regelung eines auf die Gesamtwirtschaft ausstrahlenden Zweiges der Energiewirtschaft, der in den letzten Jahren teils eine schwunghaft aufstrebende, teils eine krisenhaft stuermische Entwicklung durchlaufen hat. Der Energy Reorganization Act von 1974 wird beruecksichtigt, auf dessen Grundlage anfangs 1975 die Atomic Energy Commission aufgeloest wurde und ihre Funktionen der Nachfolgeorganisationen Energy Research and Development Administration und Nuclear Regulatory Commission uebertragen wurden.
