Nuclear energy law between the request for phasing out nuclear energy and the European Internal Market

The meeting dealt with the legal problems of the effects of the discussion on nuclear energy abandonment on the enforcement of nuclear law, and the effects of the future European Internal Market on national nuclear law. The constitutional legal framework of nuclear energy use, the effects of the loss of the Federal Government/Laender consent, and radioactive waste management pursuant to the Atomic Energy Act are discussed. Questions arising from the realization of the European Internal Market for legislature and executive in the field of peaceful uses of nuclear energy are looked at more closely for the first time. National aspects of present nuclear law are supplemented by comparisons of laws from European neighbouring states (Switzerland, Netherlands, Italy, Great Britain, and Sweden). In a final round-table discussion experts develop and discuss a nuclear energy law concept for the decade to come. (orig./HP)
