Description
Legal discussions on long-term safety under the Constitutional Law, the highest ranking law, center around the crucial point as to whether the State bears the responsibility towards future generations. The prevalent opinion affirms this because of the objective function of Basic Rights: Basic Rights provide for protection of future generations. This statement gives rise to the real legal problem which the paper investigates: For which periods, for how many generations, and in which intensity do the protective duties of the State apply. Solutions are offered via the protection of Basic Rights established for the current generation. (HSCH)
Abstract (German)
Die rechtswissenschaftliche Diskussion zur Langzeitsicherheit bewegt sich im Verfassungsrecht, dem hoechstrangigen Recht, um den Kernpunkt, ob dem Staat Verantwortung gegenueber nachfolgenden Generationen auferlegt ist. Die herrschende Meinung bejaht dies aus der objektiven Funktion der Grundrechte: Die Grundrechte bieten Nachweltschutz. Mit dieser Feststellung beginnen die eigentlichen rechtlichen Probleme, die der Beitrag untersucht: Fuer welche Zeitraeume, fuer wieviel Generationen, in welcher Intensitaet gelten die Schutzpflichten des Staates. Loesungsmoeglichkeiten bieten sich ueber den Grundrechtsschutz, der fuer die gegenwaertige Generation festgelegt ist. (HSCH)Additional details
