The devision of the Federal Constitutional Court concerning the licensing of fast breeder reactors
Description
With its decision of August 8, 1978 - 2BvL 8/77-, which was published on December 8, 1978, the Federal Constitutional Court has stated that the licensing of fast breeder reactors according to atomic energy law is compatible with fundamentary law. Due to its importance for the interpretation of the Atomic Energy Act and the assessment of technical risks, the decision is printed in full wording along with the guiding principles and part B of the reasons for decision. Part A of the reasons deals, in great detail, with the decision for appeal of the Higher Administrative Court at Muenster. (orig./HP)
Abstract (German)
Das Bundesverfassungsgericht hat mit einem am 8.12.78 veroeffentlichten Beschluss vom 8.8.78 - 2 BvL 8/77 - bestaetigt, dass die Genehmigung von Schnellen Bruetern nach dem geltenden Atomgesetz mit dem Grundgesetz vereinbar ist. Im Hinblick auf die grundsaetzliche Bedeutung der Entscheidung fuer die Interpretation des Atomgesetzes und die Beurteilung technischer Risiken ist der Beschluss, die ihm vorangestellten Leitsaetze und den Teil B der Gruende, in dem die Zulaessigkeit der Vorlage und die Entscheidung selbst begruendet werden, im Wortlaut abgedruckt. Teil A der Gruende befasst sich ausfuehrlich mit dem Vorlagebeschluss des OVG Muenster. (orig./HP)Additional details
