Higher Administrative Court at Muenster expresses doubts concerning the constitutional character of section 7 of the Atomic Energy Act

In connection with the procedure in contentious matters over the SNR 300, the chairman of the 7th senate of the Higher Administrative Court at Muenster has sent participants in the procedure a document, in which it is pointed out that in order to come to a decision in the law case in question within the framework of dutiful exercise of the judicial right of control, the constitutional character of section 7 of the Atomic Energy Act would have to be examined and also, whether the principles of basic law would be still warranted if the executive, and not parliament, makes decisions with considerable consequences (ultimate storage, plutonium industry, etc.) - Note: The matter was passed on to the Federal Constitutional Court on the 18th August 1977 in order that the constitutional character of section 7 of the Atomic Energy Act may be examined.
