Lueneburg Higher Administrative Court: Decision of August 28, 1980 - Brunsbuettel reactor

The obligation to get a licence for substantial modifications does not necessarily imply that a formal administrative procedure has to be carried out since renewed public announcement and availability of documents for inspection are only required if facts are manifested which may be of legal relevance to third party interests. This will not be the case with modifications that do not raise aspects which might be detrimental to the safety level of the installation. If such aspects are mentioned, too, then potentail objections have to be discussed with the third parties affected before a licence is granted according to the essence and purpose of procedural rules made according to the Atomic Energy Law.
