Delayed NPP decommissioning due to blocked landfills?

Description

The speedy dismantling of decommissioned power reactors in Germany is threatening to come to a standstill at some sites: Despite clear requirements in nuclear, radiation protection and waste legislation regarding the suitability for landfill and disposal of non-radioactive waste, it can be observed that their disposal is increasingly failing. The cases are now before administrative courts in various federal states. Reason enough to ask why this is the case: Are there gaps in the legislator's regulatory concept or do the deficits lie in enforcement? And what needs to be done?

Abstract (German)

Der zügige Rückbau stillgelegter Leistungsreaktoren in Deutschland droht an manchen Standorten ins Stocken zu geraten: Trotz klarer Vorgaben im Atom-, Strahlenschutz- und Abfallrecht zur Deponiefähigkeit und Entsorgung nicht radioaktiv belasteter Reststoffe ist zu beobachten, dass ihre Entsorgung immer häufiger nicht gelingt. Die Fälle beschäftigen inzwischen Verwaltungsgerichte in verschiedenen Bundesländern. Anlass und Grund genug, die Frage zu stellen, woran das liegt: Weist das Regelungskonzept des Gesetzgebers Lücken auf oder liegen die Defizite im Vollzug? Und was ist zu tun?
